When it comes to seeking justice in legal matters, there is a common belief that men should always go to the Rabbinic courts, while women should opt for the Family courts. However, as someone who has litigated in both courts and represented both men and women, I can confidently say that this notion is simply not true. Each case should be evaluated independently, considering various factors. Here are some key considerations:

  • Consolidation of Lawsuits: In Rabbinic courts, everything can be addressed in a single lawsuit, whereas in the Family courts, multiple lawsuits may be required.
  • Asset Valuations: The Family courts generally possess a higher level of sophistication when it comes to understanding and evaluating the worth of assets involved in the case.
  • Evaluation of Child/Parent Relationships: Family courts often display a greater level of professionalism in assessing child/parent relationships. They utilize reports from psychologists and social workers, which can contribute to a more comprehensive evaluation.
  • Religiosity: Rabbinic courts may take into account any changes in one party’s religious observance as a factor in their rulings.
  • Legal Impact: The specific laws applied in each court can influence the rulings. For example, a woman’s assets may receive more protection during the distribution of assets in Rabbinic court compared to the Family court.

It is important to remember that every case is unique and must be evaluated individually. However, all other factors being equal, I tend to favor the Family courts. This preference is particularly relevant when it comes to matters of custody and visitation after divorce.
